Portrait Session Terms and Conditions

1. Booking Fee and Payment

1.1. A non-refundable booking fee of $50 is required within 48 hours of making a booking to secure your portrait session date and time.
1.2. Payment of the booking fee can be made via bank transfer to the following account:

Account Number: 3658-7495
Reference: Please use your name as the payment description.
1.3. The booking fee will be credited towards the total session fee, which is payable in full on the day of your portrait session.
1.4. Accepted payment methods include cash, PayPal, or direct deposit.

2. Cancellations and Rescheduling

2.1. The booking fee is non-refundable in the event of cancellation.
2.2. If you wish to reschedule, please provide at least 48 hours’ notice. Rescheduling within 48 hours may require a new booking fee to secure a future date.
2.3. In the unlikely event that Sean Cocksey Photography must cancel or reschedule, all efforts will be made to offer an alternative date. If no suitable date can be arranged, your booking fee will be fully refunded.

3. Copyright and Image Use

3.1. All photographs are protected by the Copyright Act 1968 (Cth) from the moment of creation.
3.2. Sean Cocksey Photography retains full copyright ownership of all images created during the portrait session.
3.3. By booking a portrait session, you acknowledge and agree that Sean Cocksey Photography reserves the right to copy, reproduce, display, publish, or create derivative works from the original images for portfolio, promotional, and marketing purposes (including website, social media, and printed materials), unless otherwise agreed in writing prior to the session.
3.4. The client (the person who made the booking) is granted a personal licence to reproduce, print, and share the images from their session for non-commercial purposes.
3.5. Commercial use, resale, or publication of the images without prior written consent from Sean Cocksey Photography is strictly prohibited.

4. Liability

4.1. All reasonable care will be taken during the photography session. Sean Cocksey Photography shall not be liable for any loss, damage, or injury sustained before, during, or after the session.
4.2. In the unlikely event of equipment failure, accidental loss of images, or unforeseen circumstances beyond the photographer’s control, liability shall be limited to a full refund of all payments received or a rescheduled session, at the photographer’s discretion.

5. Client Responsibility

5.1. Clients are responsible for arriving on time and prepared for the session. Late arrival may result in reduced session time without any adjustment to the fee.
5.2. Clients are encouraged to communicate any specific requests or preferences in advance to ensure a smooth and enjoyable session experience.
